Terms of Service

Effective Date: July 4, 2026

Welcome to The Trusty Books. These Terms of Service (“Terms”) govern your use of our website and services. By signing up or using our services, you agree to these Terms.

1. Services Overview

The Trusty Books provides catch-up and clean-up bookkeeping services and related support — including law firm bookkeeping covering operating and trust account reconciliation — delivered remotely with communication and deliverables handled by email. Most services are delivered as one-time, fixed-fee projects based on a scope agreed in advance. Optional ongoing monthly bookkeeping is also available if you choose it.

2. Eligibility

To use our services, you must be at least 18 years old, operate a business in the United States, provide accurate information, and have the legal authority to enter into this agreement.

3. Accurate Information & Access

You are responsible for providing accurate information, keeping any access you grant us (for example, to your accounting software or bank statements) properly scoped and current, and notifying us immediately if you believe any shared access has been compromised. We never hold signature authority over your accounts, and we never initiate or receive transfers from them.

4. Fees and Payment

Fixed-fee project work is quoted in advance and paid via Stripe before work begins. For multi-year projects, payment may be split into phases as set out in your quote. If you choose optional ongoing monthly bookkeeping, it is billed monthly via Stripe. All fees are non-refundable.

5. Project Scope & Timeline (Important)

A. Scope Creep & Material Deviation:
Our fixed-fee quotes are calculated based on the transaction volume, complexity, and account count you represent during the initial review. If the actual work required exceeds your estimated volume by 15% or more, or if undisclosed accounts or entities are discovered, The Trusty Books reserves the right to (a) adjust the fixed fee to reflect the actual scope, or (b) issue a separate fixed-fee quote for the additional work, agreed with you before that work begins.

B. Dormancy & Delay Policy:
To keep projects on track, all required documents must be provided within 10 business days of our request. If a project is stalled for more than 30 days due to missing client information, it will be placed in “Dormancy Status,” and a reactivation fee of $250 will be required to restart it. If a project is stalled for over 90 days, it will be considered closed, with no refund of fees paid. For priority-scheduled projects, your quote may set shorter document timelines, which take precedence over the defaults above.

6. Your Obligations

As a client, you agree to provide timely and accurate documentation and respond promptly to our requests for clarification. You agree not to use our services for illegal or fraudulent activities.

7. Our Responsibilities

We will deliver services according to the agreed scope of your engagement, maintain professional standards, and keep your data secure. We are not liable for errors caused by incomplete information you provide.

8. Limitation of Liability

To the fullest extent permitted by law, our total liability is limited to the amount you paid for services in the 12 months prior to the claim. We do not provide tax or legal advice.

9. Service Standards

We provide professional bookkeeping using generally accepted bookkeeping practices. Our services are provided “as is” without guarantees of specific tax outcomes. Our work is limited to keeping your books accurate, reconciled, and organized; we do not provide legal, compliance, or tax advice, and responsibility for regulatory compliance — including trust-account compliance for law firms — remains with you.

10. Intellectual Property

The Trusty Books name and logo are our intellectual property. You retain ownership of your financial data.

11. Termination

You may stop using our services at any time. Upon termination, we will provide a final export of your data.

12. Confidentiality

We will keep your business and financial information confidential and secure.

13. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance.

14. Dispute Resolution

If a dispute arises, the parties agree to resolve it through the following process:

  • Step 1 — Informal resolution: The parties will first attempt to resolve the dispute in good faith for 30 days, by email or other mutually agreed means.
  • Step 2 — Binding arbitration: Any dispute not resolved informally will be finally settled by binding arbitration before a single arbitrator, conducted virtually (online) and in English under established arbitration rules.
  • Costs: Each party bears its own costs of the arbitration unless the arbitrator decides otherwise.
  • Confidentiality: The arbitration proceedings and the award are kept confidential.
  • Finality: The arbitrator’s decision is final and binding, and judgment on the award may be entered by any court of competent jurisdiction.
